Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the YardQuote platform ("Service"), operated by StanHattie LLC ("we," "us," or "our"), a limited liability company registered in the State of Iowa.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

YardQuote is a national lawn care quoting and lead-capture platform for contractors. Homeowners can submit a service address and request through a contractor's branded landing page or embeddable widget. Automatic property measurement currently covers supported properties in Polk County, Iowa and uses Polk County GIS parcel records and FEMA/ORNL USA Structures building-footprint data, licensed under CC BY 4.0. Google is used for address geocoding and optional static map previews, not structure measurement. Addresses outside automatic coverage can be captured for a manual quote from the contractor. The Service also includes lead delivery, crew scheduling and optional GPS tracking, before/after photo proof, customer reviews, and operations tools, depending on plan.

3. User Accounts

Certain features of the Service require registration. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Contractor Subscription Terms

4a. Pricing

Contractor subscriptions are offered in tiers: Solo ($9/month), Pro ($39/month), Crew ($99/month), and Enterprise ($349/month), with annual billing available at a discount (two months free). Every tier includes unlimited quotes and leads with no per-lead fees. Higher tiers unlock additional features such as removal of the "Powered by YardQuote" badge, SMS and webhook lead delivery, multiple crews and employees, per-business analytics, and the operations toolkit. The features included in each tier are shown on the pricing section of your dashboard and may be updated over time.

4b. Free Trial

New contractor subscriptions include a 14-day free trial. Your paid subscription begins at the end of the trial period unless you cancel before the trial expires. You are not charged during the trial.

4c. Billing

Subscription fees are billed monthly or annually (as selected at checkout) via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law.

4d. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. After cancellation, your embed widget will stop generating new quotes, but your existing lead data will remain accessible for 90 days. After 90 days, data associated with your account may be deleted.

4e. Downgrade and Lapse

If you downgrade to a lower tier, features exclusive to your previous tier (for example additional crews, employees, SMS or webhook lead delivery, per-business analytics, or the operations toolkit) stop being available at the start of the next billing period, though the underlying data already created on your account is retained. If your subscription lapses entirely, your branded quote tool and landing page are deactivated; you may reactivate at any time by renewing. Historical data (quotes, leads, jobs) is retained for 90 days after cancellation, after which it may be deleted.

4f. Operations Toolkit, Contract Templates, and Resources

The Enterprise operations toolkit includes contract templates, outreach templates, and informational insurance, tax, and hiring resources. These materials are provided on an "as is" basis as customizable starting points and general information only. They are not legal, tax, accounting, or insurance advice, and using them does not create any professional relationship between you and StanHattie LLC. Laws and requirements vary by state and situation and change over time; you should have a licensed attorney or other qualified professional review and adapt any template before you use it. You are solely responsible for the content of every agreement, message, or document you create, edit, or send using the toolkit, for the accuracy of the information you enter, for sending agreements only to people you have a legitimate business relationship with, and for legal compliance (including electronic-signature, contract, consumer-protection, anti-spam, and licensing laws) in the jurisdictions where you operate. A customer's electronic acknowledgment of an agreement (a typed name, an affirmative checkbox, and a recorded timestamp and network address) is a convenience record of acceptance and is not a notarized or witnessed signature. StanHattie LLC does not guarantee the legal sufficiency, enforceability, or fitness for any purpose of any template, agreement, or resource, and is not a party to any agreement you form with your customers. To the maximum extent permitted by law, StanHattie LLC is not responsible or liable for your use of these materials.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to access, tamper with, or use areas of the Service that you are not authorized to access
  • Scrape, crawl, or use automated means to extract data from the Service beyond normal API use
  • Interfere with or disrupt the integrity or performance of the Service
  • Submit false, misleading, or fraudulent information through the Service
  • Use the Service to send spam, unsolicited messages, or harassing communications

6. Quotes and Estimates

All quotes generated by YardQuote are estimates based on public parcel and structure data. The customer may select the whole yard, front only, or back only. Front-only and back-only automated quotes use 50% of the estimated full mowable area. The contractor's configured pricing rules and minimums still apply. Quotes are not guarantees of final pricing, and the contractor confirms the final boundaries, conditions, and price.

7. Data Accuracy

We make reasonable efforts to provide accurate data, but we do not warrant that county parcel data, including Polk County GIS, FEMA/ORNL USA Structures, geocoding, or static map information is complete, accurate, or current. Missing, shared, boundary-crossing, malformed, or implausible structure geometry requires manual review. The data may not identify driveways, patios, pools, fences, landscape beds, obstacles, slopes, or current turf conditions.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by StanHattie LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, StanHattie LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless StanHattie LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

12. Data Retention

  • Active accounts: data retained while the account is active
  • Cancelled accounts: data retained for 90 days, then deleted
  • Transaction records: retained for 7 years per IRS requirements
  • Audit logs: retained for a minimum of 2 years

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Polk County, Iowa.

14. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@theyardquote.com. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal legal action in accordance with Section 13.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
