Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the YardQuote platform ("Service"), operated by StanHattie LLC ("we," "us," or "our"), a limited liability company registered in the State of Iowa.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

YardQuote provides an instant lawn care quoting tool that uses county parcel records and satellite building data to estimate yard size and generate mowing price quotes. The Service is available to homeowners (free) and to lawn care contractors (paid subscription).

3. User Accounts

Certain features of the Service require registration. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Contractor Subscription Terms

4a. Pricing

The contractor embed widget subscription is $29 per month. This includes unlimited quotes, unlimited leads, custom branding, and custom pricing configuration. No per-lead fees apply.

4b. Free Trial

We may offer a free trial period at our discretion. If a trial is offered, your subscription will begin at the end of the trial period unless you cancel before the trial expires.

4c. Billing

Subscription fees are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law.

4d. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. After cancellation, your embed widget will stop generating new quotes, but your existing lead data will remain accessible for 90 days. After 90 days, data associated with your account may be deleted.

4e. Downgrade

If your subscription lapses, your embed widget will be deactivated. You may reactivate at any time by renewing your subscription. Historical data (quotes, leads) is retained for 90 days after cancellation.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to access, tamper with, or use areas of the Service that you are not authorized to access
  • Scrape, crawl, or use automated means to extract data from the Service beyond normal API use
  • Interfere with or disrupt the integrity or performance of the Service
  • Submit false, misleading, or fraudulent information through the Service
  • Use the Service to send spam, unsolicited messages, or harassing communications

6. Quotes and Estimates

All quotes generated by YardQuote are estimates based on publicly available county records and satellite data. Quotes are not guarantees of final pricing. Actual pricing may vary based on yard conditions, accessibility, terrain, and other factors not detectable from remote data. A professional on-site inspection is recommended before committing to recurring service.

7. Data Accuracy

We make reasonable efforts to provide accurate data, but we do not warrant that the information provided by county GIS records, satellite imagery, or geocoding services is complete, accurate, or current. Data may contain errors, be outdated, or be unavailable for certain properties.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by StanHattie LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, StanHattie LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless StanHattie LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

12. Data Retention

  • Active accounts: data retained while the account is active
  • Cancelled accounts: data retained for 90 days, then deleted
  • Transaction records: retained for 7 years per IRS requirements
  • Audit logs: retained for a minimum of 2 years

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Polk County, Iowa.

14. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@theyardquote.com. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal legal action in accordance with Section 13.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
